Concealed Carry Application Process

The Sedgwick County Sheriff’s Office has
developed an interim process for citizens of Sedgwick County to
apply for a permit to carry a concealed handgun. Although the
Attorney General’s Office will not issue permits until January of
2007, the applications are now available. “However, submitting the
application is not the first step for anyone wishing to apply for a
permit,” states Sheriff Gary Steed. An eight-hour training class is
required first. The office of the Attorney General has published a
list of certified trainers on their website
www.ksag.org along with the application that may be downloaded
starting July 1st, 2006.

Concealed
Carry Application may also be
downloaded here or picked up at the Sheriff Records Section at 141
W. Elm at anytime, or the Sheriff Training Academy, located at 2235
W. 37th Street North, Monday through Friday from 8:00
a.m. to 5:00 p.m.
Once a Sedgwick County resident has
received the mandatory training, they can bring the completed
application packet and fees to the Sedgwick County Detention
Facility, located at 141 W. Elm, Wichita, Kansas on Tuesdays,
Thursdays, and Saturdays from 9:00 a.m. to 4:00 p.m. starting on
July 6, 2006. There, the applicant will be fingerprinted and the
Sheriff’s Office will forward the paperwork to the Attorney
General’s Office for a criminal background check by the Kansas
Bureau of Investigation. The Attorney General’s Office will then
determine if a permit will be granted.
Sheriff Steed states: “we will continue to
work on these interim procedures in order to streamline our end of
this process, and help any citizen that wishes to apply for a
permit.” The Kansas
Personal
and Family Protection Act (senate bill 418) spells out the

FAST FACTS
Who can apply for a permit?
You must be a Citizen of the United States, a Sedgwick County
resident, and 21 years or more of age;
Cannot suffer from a physical infirmity which prevents the
safe handling of a weapon;
Never been convicted or placed
on diversion (even as a juvenile), in this or any other
jurisdiction, for an act that constitutes a felony under the
laws of this state;
You have not been, during the
five years immediately preceding the date the application is
submitted:

a mentally ill person or
involuntary patient;
-
committed for the abuse of a
controlled substance;
-
convicted or placed on
diversion for an act under the provisions of the uniform
controlled substances act (even as a juvenile);
-
committed for the abuse of
alcohol;
-
convicted or placed on
diversion two or more times for an act that constitutes a
violation of Driving Under the Influence;
-
convicted or placed on
diversion (even as a juvenile) for an act that constitutes a
domestic violence misdemeanor;
-
convicted or placed on
diversion (even as a juvenile), in this or any other
jurisdiction, for an act that constitutes a violation
Criminal Use of Weapons;
You are not subject to a
restraining order issued under the protection from abuse act, or
under the protection from stalking act;
You are not in contempt of court
in a child support proceeding;
You have not been dishonorably
discharged from military service.
What paperwork do I need?
You must bring with you the
following items:
A valid Kansas Driver’s License
or Non-Drivers Identification Card;
Passport-type photo
(approximately 2 inches by 2 inches) of an unobstructed, full
frontal view of your head and shoulders, taken within 30 days of
application. Your photo will not be accepted if you are wearing
anything other than transparent eyeglasses;
Certificate of Training in a
form approved by the Attorney General or an affidavit from a
certified instructor (a list of certified instructors is being
compiled by the Attorney General’s Office and is available on
their website);
Cashier’s Check or Money Order
for $40.00 payable to the Sedgwick County Sheriff’s Office;
A separate
Cashier’s Check or Money Order for $110.00 payable to the
Attorney General’s Office;
Completed application form.

I have all of the paperwork. Now
what?
Initially, on Tuesdays,
Thursdays, and Saturdays between the hours of 9:00 a.m. and 4:00
p.m., take ALL of the required paperwork to the
Sedgwick County Sheriff’s Office Detention Facility, 141 W. Elm
and you will be fingerprinted.
The Sheriff’s Office will accept
your application and accompanying paperwork and forward it to
the Attorney General’s Office for consideration of a permit.
I am an out-of-state resident
with a permit from that state. Can I apply for a permit in Kansas?
Only Sedgwick County residents
can apply for a permit here. If your state of residence has
been granted reciprocity with Kansas law, you may be allowed to
carry a concealed handgun in Kansas AFTER January 1, 2007. The
Attorney General is compiling a list of those states and that
list should be available soon. However, NO ONE will be allowed
to carry a concealed handgun until January 1, 2007.
Will I get a card to carry with
me?
The Attorney General’s Office
will NOT issue any permits until January 2007. At that time,
you will instructed by that office to go to a local Department
of Motor Vehicle Station to get either a new driver’s license or
ID card with a Carry Concealed Handgun (CCH) endorsement, or a
separate CCH card. You will be required to pay a fee for the
card.
Will I be authorized to carry a
concealed handgun into another state with my Kansas permit.
While other states have
concealed carry laws, some may or may not recognized concealed
carry permits issued by other states including Kansas.
Kansas concealed carry licensees are cautioned to check with the
licensing authority in each state before traveling.
Are out-of-state carry concealed
licenses recognized by the state of Kansas?
A non-resident concealed carry
licensee from a state recognized by the state of Kansas must: 1)
be a resident of the state where the license was issued; 2) be
able to show proof of licensure and residency from the state of
issuance; and 3) abide by Kansas concealed carry laws while
traveling, visiting or working in this state.
